By purchasing a service from Fabric IX you agree to and understand the policies and facts stated on our site.

1, Contract Agreement
a, All Contracts are binding for the term agreed upon entering through a purchase. Fabric IX offers no early exit fee’s. If a service is not fit for use any contract will be void and no invoice issued. Upon early termination, full payment must be made for the total sum of the remaining months on the contract. Users have 30 days from the date a service is first usable to request a full refund of setup and monthly fees if a service is not of acceptable quality. It is important for our customers to understand that these terms and conditions may change from month to month, and as such Fabric IX strongly recommends customers read through the terms and conditions prior to entering any new contracts. Fabric IX reserves the right to change these terms without warning.
b, Fabric IX NBN refers to services delivered by Fabric IX over the National Broadband Network – nbn™. Fabric IX delivers these services through a range of Layer3 wholesaler providers.
c, Fabric IX NBN Services are delivered through both ours and a range of 3rd party L2 and L3 handoffs and networks.

2, Privacy Policy
a, Fabric IX will not intentionally disclose any personally identifying information pertaining to you to any party. Disclosure will result in immediate nonfiction of affected users.
(including the information you submit when creating an account or placing any orders with Fabric IX). Fabric IX stores information about you such as your name, address, phone number and billing history. This information enables Fabric IX to contact you if necessary.
b, Fabric IX does not resell or share any information collected on your usage or personal details unless explicilty required by law or an Australian Court Order.
c, Fabric IX does not condone criminal acts, and as such any illegal activity is prohibited. Please refrain from partaking in ethically and legally questionable behavior whilst using a Fabric IX NBN product.

3, Service Level Agreement
a, Fabric IX offers no form of Service Level Agreement(SLA) on any Fabric IX NBN product. We will always make our best effort to provide an outstanding service however we bare no responsibility for our wholesale and partner networks which are used to deliver services.

4, MetaData
a, Fabric IX Stores Metadata on all DSL and NBN clients in full accordance with Australian Legislation. If a request is made for a client’s data we will be in contact with that client ASAP to inform them of the data request as well as to offer guidance so you know your rights and how to navigate the situation.

5, Hacking Policy
a, Hacking illegally is a crime, and as such Fabric IX prohibits any such action. Fabric IX appreciates where vulnerabilities in its network are identified and suggestions for patches, but reminds customers and other parties that any illegal breaches of our network will be dealt with accordingly.

6, Payment & Lateness Policy
a, Fabric IX’s billing system will generate a bill automatically based on the details of the service ordered by the customer. This bill must be paid for service to be provided.
b, Fabric IX reserves the right to discontinue providing services to those who do not pay their bills. If you believe you may have difficulty with a bill, please contact Fabric IX through any of the contact methods on our site so that we can discuss options for you.
c, Fabric IX does not charge late fees by default. However, we retain the right to charge a fee of 20% of the total value of an invoice to users whose accounts are consistently found in arrears without being in contact with our team.

7, Refund Policy
a, Fabric IX is not required to provide a refund if you change your mind about the services you asked for or misunderstood the technical limitations- We will provide a full and prompt refund on any and all connections that perform outside of what is considered effective operational range.

8, Network Performance
a, All of Fabric IX’s NBN services are advertised with an average evening speed. This speed reflects what the average Fabric IX client using FTTP technology experiences on a day to day basis. These numbers are updated monthly based on data collected from a number of points within our and end user network. Including internal engineering graphs, data, and speedtests provided to us by end users.
Commercial/Business Activity
b, Fabric IX’s plans apply to all customers, business and commercial included. Fabric IX requires that all customers keep in mind that they are under our fair use policy and breaches of this will be dealt with accordingly.

9, Acceptable Usage Policy
a, Fabric IX is designed to serve the needs of all Australians. It is not appropriate to use our services to support large enterprises or internationally based businesses with a sustained demand that places an undue burden on our systems or negatively impacts use by small, independently owned and operated businesses.
Fabric IX’s network is private, unique and not of the internet. We put much pride in our ability to transmit client data over private networks and hidden paths. In cases when this is not possible, the service MAY be routered through an internet-enabled router while passing through more open networks.

10, Generally banned Content
a, You may not publish or transmit via a Fabric IX service any content that Fabric IX reasonably believes:
a.1) constitutes child pornography;
a.2) constitutes cruelty;
a.3) is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
a.4) is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
a.5) is defamatory or violates a person’s privacy;
a.6) creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with an investigation by law enforcement;
a.7) improperly exposes trade secrets or other confidential or proprietary information of another person;
a.8) is intended to monitor or hack other users;
a.9) infringes on another person’s trade or service mark, patent, or other property rights;
a.10) illegal arms trafficking;
a.11) is otherwise malicious, fraudulent, or may result in retaliation against Fabric IX by offended viewers, Governments or 3rd parties.
